Who can adopt a child in South Australia? South Australia has its own legislative requirements relating to adoption. Approval for adoption in the majority of cases are made in favor of married couples, or couples who have been in a de facto relationship for at least two years. Only in very exceptional circumstances will a single person be considered for adoption.
The State Adoption Authority will make an assessment regarding the suitability of a couple making an application for adoption. All Couples applying must be able to meet the “fit and proper” test, as well as demonstrating that they are able to financially and emotionally support the adopted child.
Adoption applications are rejected if any applicant fails the character test, this may include for example, a person who was previously been found guilty of a criminal offence against a child will clearly be automatically denied their application. For other past criminal matters, a decision will be made on the suitability of a person applying for an adoption by taking into account the type of offence, as well as other factors such has the duration since the offence and their overall character since the offence.
